CLOVERLAND ATL – ATV + EVENT LIABILITY WAIVER & RELEASE

BY SIGNING THIS DOCUMENT YOU GIVE UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.

1. ASSUMPTION OF RISK – BONFIRE, NIGHT EVENT, AND OUTDOOR ACTIVITIES

I, the undersigned Participant (“Participant”), understand that attendance at Cloverland ATL Glow Night, including but not limited to bonfires, nighttime events, food trucks, walking on outdoor terrain, glow lighting, crowds, music, and environmental conditions, involves inherent risks such as:

Burns, sparks, embers, fire hazards
Slips, trips, and falls on uneven or natural ground
Exposure to smoke, weather, insects, and wildlife
Injuries from interacting with other participants
Hot liquids, food, or beverage-related injuries
Limited visibility due to nighttime or event lighting

I voluntarily accept all risks associated with participation, whether known or unknown.

2. GENERAL RELEASE OF LIABILITY (EVENT-WIDE COVERAGE)

In consideration for being allowed to attend the event, I fully and forever RELEASE, DISCHARGE, AND HOLD HARMLESS:

Cloverland ATL
Property owners
Officers, staff, volunteers, contractors, and affiliates

From ANY AND ALL claims, damages, injuries, losses, or liabilities arising from my presence at or participation in the event, even if caused by the NEGLIGENCE of Cloverland ATL or its representatives.

This includes but is not limited to:

Injuries caused by fire or bonfire conditions
Injuries caused by other guests
Trip and fall incidents
Weather or environmental hazards
Property damage or loss

3. ALCOHOL & INTOXICATION ACKNOWLEDGMENT

I understand that alcohol may be present and agree that:

I am solely responsible for my alcohol consumption.
Cloverland ATL is not responsible for injuries caused by intoxicated guests.
If I appear impaired or unsafe, I may be removed from the event without refund.

4. INDEMNIFICATION AGREEMENT

I agree to INDEMNIFY, DEFEND, AND HOLD HARMLESS Cloverland ATL and all affiliated parties against any claims arising from:

My conduct
My negligence
My violation of rules or laws
Harm or injury I cause to any person or property

This includes attorney fees, settlements, judgments, and court costs.

5. MEDICAL AUTHORIZATION

If I am injured and cannot consent, I authorize Cloverland ATL to obtain emergency medical care on my behalf.

I accept full responsibility for all medical expenses incurred.

6. PHOTO & MEDIA RELEASE

I authorize Cloverland ATL to use my image, voice, or likeness captured by photo or video for any promotional or commercial purpose without compensation.

7. RULES, CONDUCT, AND REMOVAL POLICY

I agree to follow all rules and instructions given by Cloverland ATL staff.

I understand I may be removed without refund for:

Unsafe or reckless behavior
Harassment or disorderly conduct
Alcohol intoxication
Entering restricted or animal areas
Violating event rules or safety warnings

8. NO REFUNDS

All ticket purchases, entry fees, and payments are non-refundable for any reason, including:

Weather
Personal schedule conflicts
Removal from the event
Changes in planned activities

9. GOVERNING LAW & ARBITRATION

This waiver is governed by Georgia law.

Any disputes must be resolved through binding arbitration in Fayette County, Georgia, not through litigation.

I waive the right to sue and the right to a jury trial.

10. ATV-SPECIFIC ASSUMPTION OF RISK (APPLIES IF PARTICIPATING IN ATV ACTIVITIES)

If I ride, operate, or am a passenger on any ATV during the event, I understand the activity involves heightened and extreme risks, including:

High-speed operation
Collisions, rollovers, impact with obstacles
Mechanical failure or operator error
Blunt force trauma, fractures, paralysis, or death
Reduced nighttime visibility
Injuries caused by other riders

I knowingly and voluntarily accept ALL ATV-related risks.

11. ATV RULES & SAFETY REQUIREMENTS

I agree that:

No ATV operation is allowed under the influence of alcohol or drugs.
I must follow all staff instructions.
Reckless driving, speeding, drifting, stunts, or unsafe behavior is prohibited.
Safety gear (if provided or required) must be worn correctly.

12. ATV DAMAGE RESPONSIBILITY

I accept full financial responsibility for:

Any ATV or equipment damage caused by my riding
Damage resulting from rule violations, negligence, or unsafe behavior

13. ATV LIABILITY RELEASE (SPECIFIC PROTECTION FOR CLOVERLAND ATL)

I fully and forever release Cloverland ATL from any claim arising from ATV riding or participation, including but not limited to:

Bodily injury
Property damage
Emotional distress
Death
Injuries caused by other participants
Mechanical failure
Rider error

This release applies even if Cloverland ATL is negligent.

14. ATV INDEMNIFICATION

I agree to indemnify and defend Cloverland ATL from any claim brought by:

Myself
My family or estate
Any third party harmed by my actions
Any person injured due to my riding

15. FINAL ACKNOWLEDGMENT

By signing below, I acknowledge:

I have read and understand this waiver in full.
I am at least 18 years of age.
I voluntarily waive substantial legal rights.
This waiver applies to both event participation and ATV activities (if applicable).
